Many people believe that once their corporation, limited liability company or other entity is formed they have an absolute right to use the entity's name and have trademark protection for that name. The fact is, filing your entity with a state corporate commission merely confirms that your name is not confusingly similar to that of another entity registered in that state. It does not, by itself, afford your business name trademark protection. Nor does it guarantee that you are not infringing on someone else's trademark.
